Non Contentious Drafting

I have many years experience of all the main standard forms of contracts including JCT, FIDIC, GC/Works, NEC and ICE together with sub-contracts (bespoke and standard form), guarantees, bonds and numerous other bespoke agreements.

I am frequently instructed to draft and negotiate construction contracts, bespoke agreements, professional appointments, collateral warranties, guarantees and bonds together with the construction elements of development agreements and forward sale/option agreements and in doing so work closely with clients to achieve their commercial requirements.

I provide advice on the most appropriate method of procurement suitable for a particular project and work closely with the other members of the client’s team in overcoming any specific project related issues which may result from the intended procurement route.

I provide advice to funders on protecting their investment, on the appropriate safeguards to be obtained by means of collateral warranties and on the drafting of the appointment of the monitoring surveyor.

I have advised concessionaires, contractors and major sub-contractors in relation to the complex risk transfer provisions which are encountered within both PFI and PPP schemes.

I work closely with solicitors who do not have construction expertise in-house but who are advising on development agreements/option agreements and who require specialist assistance in relation to the construction elements of those transactions.

  • Acting directly for an international hotelier to draft all of the construction documentation for use during the £80,000,000 5 year refurbishment of one of London’s leading 5 star hotels.
  • Working closely with solicitors instructed to draft the construction elements of a complex development agreement relating to the sale and lease back of a hotel and comedy club.
  • Instructed by a large international contractor to draft a suite of bespoke amendments, sub-contracts, consultant appointments, collateral warranties, bonds and parent company guarantees.
  • Drafting a joint venture agreement between an international contractor and a major mechanical and electrical contractor.
  • Instructed to act on behalf of a design and build contractor in relation to the drafting, negotiation and agreement of proposed amendments to a JCT 2005 on a £37,000,000 project.
